Governing Law and Dispute ResolutionThese terms of sale shall be governed by the laws of the State of Illinois. Any disputes arising from the sale of our products shall be resolved through arbitration in Lake County, Illinois. The customer agrees to waive any right to a trial by jury and to participate in any class action lawsuits against our store. The customer also agrees to pay any costs, fees, or expenses associated with the arbitration process.
Damage and InjuriesOur store is not responsible for any damages or injuries that may occur as a result of the use of our products. It is the customer's responsibility to use our products in a safe and appropriate manner and to follow any instructions or warnings provided with the product. The customer agrees to indemnify and hold our store harmless from any claims, damages, or expenses that may arise from the use of our products.
Sales TaxesThe customer is responsible for all taxes and duties applicable to the purchase, unless otherwise noted.
First Come, First Serve, Holds Only By DepositAll products are sold on a first come, first serve basis unless a deposit is provided. In the event that multiple customers place orders for the same product, the customer who provides a deposit will have priority. We accept deposits through Zelle, Venmo, or cash only.
DepositsIn the event that a customer places a deposit on a product and decides to cancel the order, the deposit may be used as credit towards the purchase of a different item. The deposit will not be refunded. The credit must be used within 6 months of the cancellation or any remaining balance will be forfeited.
Order CancellationOur store reserves the right to cancel any order at any time for any reason. If an order is cancelled, any payments made by the customer will be refunded in full.
Product DescriptionsOur store makes every effort to ensure that the products listed on our website are accurately described. However, our store does not warrant that product descriptions or other content of the website is accurate, complete, reliable, current, or error-free.
Product DimensionsThe dimensions of our products are provided as a reference and are approximate. Slight variations in size may occur due to the nature of our products. It is the customer's responsibility to ensure that the product will fit in the intended space. Our store is not responsible for any issues resulting from incorrect measurement or improper fit.
Item ConditionsOur store sells a variety of items in different conditions, including new, new in box, new out of box, new returned, new damaged, used like new, used good, and used fair condition. The condition of an item will be clearly stated in the product description and may affect the price of the item. It is the customer's responsibility to review the condition of the item before placing an order.
Prices & Pricing ErrorsPrices are subject to change without notice.
In the event that a product is listed at an incorrect price due to typographical error, error in pricing information received from our suppliers, or any other reason, our store shall have the right to refuse or cancel any orders placed for product listed at the incorrect price, regardless of whether the order has been confirmed or your credit card has been charged. If your credit card has already been charged for the purchase (or you have paid by Zelle, Venmo, or cash) and your order is canceled, our store will issue a credit to your credit card account (or refund to your Zelle or Venmo account) in the amount of the incorrect price.
Delivery (Curb Side Drop-Off) & Additional Installation FeesCurb side drop-off refers to the delivery of items to the customer's designated delivery address, but not inside the customer's home or to a specific room within the home. It is the customer's sole responsibility to transport items from the point of delivery (e.g. driveway, front door) into the home and to install them as desired.
Additional installation services are available for an additional fee. Additional fees vary based on moving difficulty and installation conditions. Unless otherwise noted, any mentions of delivery on our website or in external marketing is referring to “curb side drop off only”. Any quotes for delivery services are for “curb side drop off only” unless otherwise specified by us. Our store is not responsible for any injuries that may occur during the delivery process.
Difficult Moving ConditionsOur store is not responsible for any damage to the product or the customer's home that may result from difficult moving conditions, including tight doorways, elevators, turns, corners, low ceilings, hand railings, etc. It is the customer's responsibility to ensure that the product can be safely delivered to the intended location. If the product cannot be safely delivered due to difficult moving conditions, the customer may be responsible for restocking fees as stated in our return policy.
Product FitIt is the customer's responsibility to ensure that our furniture products will fit in their intended spaces, including doorways, hallways, stair cases, and elevators. Our store is not responsible for any issues resulting from incorrect measurement or improper fit. If a product is found to not fit in the customer's home due to space limitations, the product will be subject to a restocking fee. The restocking fee will be determined based on our return policy.
Contact and Delivery InformationIt is the customer's responsibility to provide accurate contact and delivery information to our store. If the customer provides incorrect or incomplete information, our store is not responsible for any issues that may arise as a result, including but not limited to: delivery delays or undelivered orders. Our store reserves the right to cancel any order if the customer does not provide accurate contact and delivery information.
AssemblyIf the product requires assembly, it is the customer's responsibility to assemble the product, unless assembly is agreed upon by all parties prior to delivery. Our store is not responsible for any damages or injuries that may occur during the assembly process. It is the customer's responsibility to follow the assembly instructions provided with the product and to use caution and proper tools during the assembly process.
Delivery TimesDelivery times for our products are estimates and are not guaranteed. Our store will make every effort to deliver products within the estimated time frame, but we cannot be held responsible for delays that may occur due to circumstances beyond our control, including but not limited to: truck breakdowns, injuries, accidents, and weather delays.
In Store Pick UpCustomers may choose to pick up their orders from our store location(s). Customers will be responsible for loading and transporting their purchases. A staff member will be available to assist with the loading process, but we recommend bringing appropriate tools and equipment (e.g. straps, cardboard, tarps) to ensure the safe transport of your items. Our store is not responsible for any injuries that may occur during the pick up process.
Offers of “FREE DELIVERY”Customers who live within a 30-minute radius of our Lincolnshire location may also be eligible for free delivery. Free delivery offers include curb side drop-off only. Additional installation services are available for an additional fee. To receive free delivery, customers must mention this offer at the time of purchase and must provide a valid delivery address within the designated radius. The offer of free delivery is only available for certain products. For a product to qualify for our “FREE DELIVERY” promotion it must be mentioned in the product description of the product listing on our website.
Used Furniture Offers & EstimatesOur store may offer to purchase used furniture items from customers for credit or cash. The purchase price for used furniture items will be determined at the discretion of our store based on the condition of the item, market demand, and other factors. Customers who wish to sell used furniture items to our store must provide accurate and complete information about the condition of the item and any damages or defects. All offers made by our store for used furniture items are estimates only and are subject to change upon inspection of the item in person. The final purchase price for a used furniture item will be determined after the item has been inspected by us and any discrepancies or damages have been taken into account. Our store reserves the right to alter or revoke any offer at any time. By selling a used furniture item to our store, the customer agrees to these terms and acknowledges that the sale is final and cannot be reversed.
Return PolicyWe accept returns within 4 days of purchase. All returns are subject to restocking fees as follows:
Please note that the original customer who purchased the item must be the same customer to return it. The returned item must be the same item sold to the customer.
When returning an item that was delivered by us, the customer is responsible for bringing the item outside of their home and making it available for pick-up by our team. If the customer prefers, they may also bring the item back to our location themselves, however, if delivery was originally provided by us the “delivered” restocking fee will still apply.
All returned items must be in the same cosmetic and functional condition as when they were picked up or delivered to the customer, or additional charges may apply based on wear, tear, and/or damages. If the items are deemed to be in a hazardous condition such as an infestation or biological containment, we reserve the right to refuse to accept a return.
No receipt is necessary for a return.
